SOFTWARE, HARD LESSONS – Think about this next time to you hit the “Remind me tomorrow” button on your software update: industry observers have begun to point out that Southwest Airlines’ recent PR nightmare over thousands of holiday flight cancellations could have been avoided had the airline taken action earlier in the year to address its glitching crew scheduling system. For attorneys watching, Southwest’s Christmas tailspin is less unusual than many think: as Law.com’s Isha Marathe reports, businesses of all kinds are increasing their “technical debt”—the cost of updating current and less robust IT solutions—and in the process increasing their legal risk.

ON THE RADAR – Seyfarth Shaw filed a trade secret lawsuit Wednesday in Utah District Court on behalf of Bill.com. The suit accuses Danielle Cox, former director of IT for the plaintiff, of surreptitiously downloading approximately 5,800 from her supervisor as well as other communications from colleagues in order to misappropriate a ‘massive volume’ of proprietary information.
