The right to trial by jury in civil law is described as inviolate in the Texas Declaration of Independence, and twice defended in the state constitution—yet that right in practice is far from certain.

This supposed right has become so precarious that two justices of the Texas Supreme Court have raised their voices in concern and made suggestions to reform the rules within the court’s control.
